Terms of use for customers

The term ‘customer’ refers to any company, organisation or individual using this site to gather information on products and services.

By using this site, the customer authorises Tendervendors to act on its behalf in gathering quotations and estimates from suppliers in accordance with our privacy policy and to use any information disclosed by the customer when using the site to that end. Tendervendors does not charge any such customer for using this service.

When gathering quotations and estimates on behalf of the customer, Tendervendors agrees not to disclose any of the following information to any suppliers or third parties without the customer’s expressed permission: the customer’s contact information; the customer’s company name; the names of any employees of the customer’s company.

Tendervendors will present the results of their search to the customer, either via a secure online form or via an emailed PDF. This information will include the names of any suppliers who have provided estimates and quotations for the products or services required by the customer according to their expressed requirements. By expressing any interest in receiving further information regarding any of these suppliers, either verbally or by using the website or in writing to Tendervendors, the customer authorises Tendervendors to approach ONLY the suppliers they have indicated and to disclose their contact information only to the chosen suppliers. This allows the suppliers to contact the customer and arrange to provide further information, which may or may not lead to the customer purchasing the product or service at their discretion. The customer is not obligated to purchase a product or service from any of the suppliers that they have selected.

By using the site, the customer agrees not to abuse the purpose of this site, which is to allow the customer to compare prices on products and services for businesses. If Tendervendors has reason to believe that the site is being abused, or that a customer is in actual fact a competitor or some other company posing as a customer for some other reason connected with corporate espionage or some other nefarious motive, Tendervendors reserves the right to withhold its services and may pursue legal action where there is a breach of copyright involved.

Terms of use for suppliers

The term ‘supplier’ refers to any company or organisation that is approached by Tendervendors and invited to provide a quotation or estimate for its products or services in relation to a query received by any customer when using this site. Tendervendors reserves the right to approach multiple suppliers of the relevant products or services in order to provide the customer with a wider choice by way of comparison.

The supplier will provide, free of charge, an estimate for any of its relevant products or services according to the requirements of the customer. By doing so, the supplier authorises Tendervendors to present the supplier’s company name and logo, estimates, credentials, and any other relevant information regarding the product or service to the customer, excluding any contact information. Tendervendors gives no guarantee to the supplier that a customer will accept any quotation given, as this is entirely at the discretion of the customer. Tendervendors also reserves the right to disclose the customer’s information to any other suppliers that have been specifically selected by the customer with a view to gathering further information.

In the event that a customer accepts a quotation given by a supplier with a view to gathering more information about the supplier or their products or services, Tendervendors will offer the customer’s information to the supplier, who by accepting the customer’s information agrees to pay Tendervendors according to the following payment structure:

  1. An administration fee of £20 shall be payable to Tendervendors, by the supplier, for any information disclosed concerning any customer, regardless of the size of the company or organisation. This fee is non-refundable.
  2. Commission shall also be payable to Tendervendors, by the supplier, dependent on the size of the company or organization. For customers with 100 (or less) stated employees (at the time of their using the site) any commission fee shall be waived, however the administration fee will still be payable. For customers with 101 (or more) stated employees (at the time of their using the site) commission shall be payable at a rate of £0.20 for every stated employee over 100 employees. Any change or fluctuation in the number of the customer’s stated employees subsequent to their using the website will have no bearing on the amount of commission payable to Tendervendors, nor will any inaccuracy on the part of the customer at the time they disclose their employee numbers to Tendervendors be sufficient grounds for altering the amount of commission payable.
  3. The administration fee and any commission due is payable to Tendervendors by the supplier within 5 working days of the supplier receiving the customer’s details, regardless of any subsequent outcome between the supplier and the customer. Once the administration fee and commission is paid in full by the supplier, Tendervendors agrees to relinquish any further claims on commission for any resulting sale or future repeat sale of the supplier’s products or services to the customer.
  4. Tendervendors may at their own discretion refund the total amount of any commission to any supplier whose products or services are subsequently declined by the customer. The administration fee of £20 is non-refundable. However, on receipt of written confirmation from the customer (not the supplier) that they have declined the supplier’s product or service and do not intend to pursue any further interest in the supplier’s products or services in the foreseeable future, Tendervendors may refund the total amount of any commission paid by the supplier on request, provided that the aforementioned written confirmation is received from the customer within six months from the time that the customer’s information was first disclosed to the supplier by Tendervendors.
  5. If Tendervendors subsequently has reason to believe that either party has abused the aforementioned refund policy, or that written confirmation has been fabricated or is in some other way misleading, it may choose to either withhold any refund, or pursue legal action against the supplier to recover any refunded monies owed accordingly.

Violation of terms of use

Tendervendors reserves the right without liability to take action against any relevant party, at any time, for any reason. Persistent abuse of the terms of use or breach of these guidelines may result in action being taken against the relevant party. These terms of use are in addition to any and all legal rights and remedies that Tendervendors has from time to time.
